TERMS AND CONDITIONS OF HIRE

1. DEFINITIONS

1.1. The “Owner” is Thank You, Baby
1.2. The “Hirer” refers to the person, firm or corporation hiring equipment from the Owner

1.3. The “Equipment” means all the equipment and accessories supplied to the Hirer 1.4. “Terms” means these Terms and Conditions of Hire

2. CONDITIONS OF HIRE

2.1. The hiring of the equipment will commence from the commencement date specified on your invoice and continue for the term specified. The Hirer is entitled to use the equipment for the hire period. Any extension of the period must be agreed to by Thank You, Baby which may be subject to additional days’ hire fee.

2.2. Late returns without prior arrangement will incur a late fee.

2.3. The Hirer acknowledges that they have received adequate instruction on the correct use of the equipment, which includes demonstration or verbal or written instructions.

2.4. The Hirer agrees not to use the equipment at locations or purposes different to the equipment’s general designated purpose and specified suitability (such as indoor versus outdoor use).

2.5. The Hirer acknowledges responsibility for the equipment and is liable for any damage.

2.6. If you receive hire goods that are damaged in any way please notify Thank You, Baby within 4 hours of collection of your items. Hire goods that are damaged and not notified to us will be assumed to be the responsibility of the Hirer.

2.7. For all collections we provide a 2 hour pick up window which you will be notified of in the week leading up to your event. If during this collection window there is no one to accept the hire goods or to return them to us a wait fee or a return delivery fee will be deducted from the bond.

3. PAYMENT

3.1. By making payment the Hirer is agreeing to the Terms and Conditions outlined in this document.

3.2. The Hirer agrees to pay Thank You, Baby the hire fee and the bond specified for the equipment for the hire period including any applicable delivery fees and other charges relevant to this agreement.

3.3. The required fees must be paid in full to Thank You, Baby 14 days prior to the commencement date of the hire period.

3.4. Conditions of payment of hire goods are as follows:


(i) A non-refundable deposit of 50% of the agreed hire price (excluding bond) is required to confirm your order.
(ii) The balance of the agreed hire price is to be made no less than 14 days prior to the commencement of the hire period.
(iii) Payment is to be made by credit/debit card (cash payments will not be accepted).

3.5. All orders placed 14 days or less from the commencement of the hire period will require full payment to confirm the booking.

3.6. All minimum spend orders of $200 will require full payment to confirm the booking.

3.7. All special purchase equipment requires full payment at point of booking in order to commence manufacture or buying process.

4. SECURITY DEPOSIT

4.1. The Hirer agrees to pay a security deposit to cover the hire items for instances such as (but not limited to):

(i) late return of hire
(ii) equipment returned unclean
(iii) missing or damaged transportation tubs/packaging

(iv) additional servicing/cleaning charges


4.2. The security bond does not cover damage or loss of equipment. The Hirer will remain liable for all repair and/or replacement costs (including all associated costs). Any debt recovery fees will also be recoverable from the Hirer.

4.3. Equipment includes all packaging items and materials which come with the hire equipment.

4.4. By proceeding with the hire you are agreeing to Thank You, Baby placing a temporary hold on your credit/debit card equal to the bond amount as shown on your invoice.

4.5. Bonds must be settled two days before commencement of the hire period by credit/debit card. Payment of the bond will not be accepted on the day of collection or delivery. It is the responsibility of the Hirer to ensure there are adequate funds on their card as hire goods cannot be collected if the bond is not paid.

4.6. The bond will be released back to the Hirer’s card no later than 7 days following the bond authorisation.

5. DAMAGE

5.1. The Hirer is responsible for the equipment from the time of pickup or delivery until collection by the Owner. If the Hirer has chosen to designate another person or company (e.g.: Courier company, Uber or Taxi driver etc.) to collect their hire goods on behalf of them, the Hirer will remain responsible for the equipment from the time it has left the Owner’s possession until its return to the Owner. The Hirer shall pay for all equipment damage or loss however caused during that period. This includes (but is not limited to):

(i) Damage resulting from overloading, exceeding rated capacity, misuse or abuse;

(ii) Damage due to mysterious disappearance of the equipment;

(iii) Damage caused by the use or operation of equipment in contravention of any of the conditions of the agreement;

(iv) Damage to, or loss of, the equipment from any unknown cause;

(v) Cigarette burns on any décor items;

(vi) Red wine/drink spillages on any furniture or décor items.

5.2. The Hirer shall protect the equipment from the elements during the time of delivery, use, storage or waiting period before pick-up.

5.3. The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the equipment hereby hired and the Hirer indemnifies the Owner in respect to any claims for such loss or damage.

5.4. Any person signing the documents for and on behalf of the Hirer hereby covenants with the Owner that they have the authority of the Hirer to make this agreement on the Hirer’s behalf and is empowered by the Hirer to bind the Hirer to this agreement and hereby indemnifies the Owner against all losses and cost incurred by the Owner arising out of the person signing this agreement failing to have such power and/or authority.

5.5. Where the Hirer is more than one person liability shall be joint.

5.6. By making a booking through confirming a quote via signature, deposit payment or remittance of funds, the Hirer acknowledges and agrees to the Owners’ Terms and Conditions.

5.7. In the case of the equipment being damaged, the hirer may have the opportunity to purchase the damaged equipment.

6. CANCELLATION POLICY

6.1. Once an invoice has been paid in full we are unable to give refunds within two weeks of your event date.

6.2. Cancellations before this will result in 50% of the hire cost being retained. The bond will be refunded in full.

6.3. We do not provide refunds in the case of wet weather. It is the responsibility of the Hirer to have an indoor/undercover alternative location in the case it rains on your event day. We will not provide goods if we believe they will be outside in rain.
